Legal Popularization of Pet Care Knowledge
With the changes in population structure and attitudes towards marriage and childbirth, more and more middle-aged and young people have begun the path of raising pets. In the process of satisfying emotional demands and realizing the value of companionship, more and more problems have emerged, among which incidents of pets injuring others are not uncommon. This article provides a detailed introduction to four types of infringement liabilities and corresponding measures for pet injuries, in order to better popularize legal knowledge and provide the public with a safe and healthy pet raising environment.
1、 Common Tort Liability
1. Violating management regulations by raising animals and causing harm to humans
Legal provisions: "If a violation of management regulations results in damage to others due to failure to take safety measures against an animal, the animal owner or manager shall bear the liability for infringement. However, if it can be proven that the damage was intentionally caused by the victim, the liability can be reduced." Violation of management regulations mainly refers to the violation of laws, regulations, and normative documents, usually manifested as walking the dog without tying the rope, raising the dog without obtaining a certificate, etc. The principle of liability attribution is the principle of no fault liability. Only when the victim intentionally causes damage can the liability be reduced and cannot be exempted.
2. Prohibited dangerous animals that cause harm to humans
If dangerous animals such as dogs that are prohibited from being kept cause harm to others, the animal owner or manager shall bear the liability for infringement. Prohibited dangerous animals not only have a high degree of danger, but are not necessary for the profession or livelihood of the breeder or manager. The principle of no fault liability attribution applies to the liability for harm caused by prohibited dangerous animals, and there is no reason to reduce or exempt liability.
3. Abandoned or escaped animals causing harm to humans
According to the law, "If an abandoned or escaped animal causes damage to others during the abandonment or escape period, the original animal owner or manager shall bear the liability for infringement." Based on the dangerous nature of the animal itself and the animal owner or manager's duty of care for social public safety, whether the owner or manager voluntarily gives up possession of the animal or passively loses possession of the animal, and the animal causes damage to others, the original owner or manager shall bear the liability for infringement
.
2、 How can pet owners effectively prevent dog injuries and ensure harmonious coexistence between humans and dogs?
1. Conduct system training
Provide good socializing training from small groups of dogs to cultivate their skills in harmonious coexistence with humans and animals. Basic remote dog training teaches dogs to follow their owner's instructions and establish good obedience.
2. Provide sufficient activities
Excessive energy in dogs can lead to anxiety and aggressive behavior. Regularly take your dog for a walk, play frisbee, and catch their excess energy. Prepare some dog activity toys at home to enrich their entertainment life.
3. Time monitoring mechanism
Whether at home or outside, dogs should be directly supervised, and when using dog leashes or cages to restrict their animals, they should be vigilant to avoid uncontrolled behavior.
4. Pay attention to body language
When a dog shows signs of tension or defense such as direct gaze, low growl, or vertical fur, the owner should immediately take isolation measures to avoid stimulating the dog's behavior.
3、 What should I do if I accidentally get scratched or bitten by a pet?
Take the following three steps
(1) Wash the wound. Wash each bite or scratch wound alternately with soapy water (or other weakly alkaline cleaning agents) and flowing water at a certain pressure for at least 15 minutes.
(2) Disinfection treatment. After thorough rinsing, apply diluted iodine, benzalkonium chloride, or other skin and mucosal disinfectants with virus inactivation efficacy to the wound or disinfect the inside of the wound.
(3) Seek medical attention as soon as possible. Go to the nearby dog injury treatment clinic as soon as possible for medical treatment. The doctor will grade the treatment according to the exposure situation, and if necessary, provide measures such as vaccination and passive immunization.
